Eligible participants may enter the Carvin Audio VLD1 Legacy Drive Sweepstakes (the “Contest”) by completing an online entry form accessible from Sponsor’s Entry form (https://carvinaudio.lpages.co/nl-giveaway-legacy-drive-may/). Limit one (1) entry per person. All entry information becomes the property of the Sponsor. Sponsor reserves the right to verify all entries. No purchase is necessary to enter. A purchase will not increase chances of winning.
A winner will be selected at random each at the end of the contest period from among all eligible entrants. Sponsor reserves the right to discontinue the Contest at any time without notice in its sole and absolute discretion. Winner are notified via email. Winner must reply to the Sponsor’s email within 48 hours to obtain instructions on claiming their prize or a new winner will be selected. Once the winner has replied within their given time frame, the winner will be announced on Sponsor’s media outlets which could include one or all of the following channels (website, Facebook, Instagram, email newsletter). Contest ends 11:59pm Pacific Standard Time, May 31, 2017.
Open to contestants who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Sponsor, its parents, affiliates and subsidiaries, Sponsor’s authorized dealers, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same of household of each) are not eligible.
4. PRIZES AND APPROXIMATE RETAIL VALUE:
A VLD1 is the Grand Prize. This prize has an approximate retail value of $499 and includes 1 VLD1 signed by Steve Vai. All expenses not listed above are responsibility of the winner. This includes shipping and any duties and taxes that would be incurred by an international winner. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Odds of winning depend upon number of eligible entries received. Prize must be claimed within seven days of winning.
5. ALL ENTRANTS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS ARE FINAL AND BINDING. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR IS NOT RESPONSIBLE FOR LOST, LATE, INCOMPLETE ENTRIES.
6. CONDITIONS OF PARTICIPATION:
No transfer, assignment or substitution of a prize, except Sponsor reserves the right to substitute prize for an item of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to the Contest.
7. RETURN OF PRIZES:
Return of any prize or prize notification as undeliverable may, at Sponsor’s sole discretion, result in disqualification and selection of an alternate winner.
8. REQUIRED RELEASES AND DOCUMENTATION:
The winner must sign and return an Affidavit of Eligibility, a liability release, including a release of Sponsor, its past and present partners, limited partners, parents, subsidiaries, affiliated entities, owners, entity owners (and the current and former officers, directors, shareholders, partners, members, limited partners, assigns and employees of any owners or entity owners), officers, directors, shareholders, members, contractors, successors, assigns and insurers (collectively, “Related Parties”) and, where legally permissible, a publicity release within seven (7) days following the date of first attempted notification. Winner must also sign and return tax related documentation and other documentation as required by Sponsor in its sole discretion within the same deadline described above. Failure to comply with the above requirements may, at Sponsor’s sole discretion, result in forfeiture of the prize and selection of an alternate winner.
Acceptance of a prize constitutes permission for Sponsor and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.
10. WAIVER AND INDEMNITY:
By submitting an entry or accepting any prize, all entrants expressly agree to forever defend, indemnify, hold harmless, waive, release, discharge, and covenant not to sue Sponsor or any Related Parties of, for and from any and all claims, debts, liabilities, demands, obligations, costs, fees, expenses, actions and causes of action whatsoever, of every nature, character and description, including reasonable attorneys’ fees and disbursements (collectively, “Claims”), known and unknown, including, but not limited to, all those arising out of or in any way related to the Contest; these Official Rules; entrant’s entry; the negligence of Sponsor or the Related Parties; the acceptance, possession, misuse or use of any prize; any travel related to the Contest; or any participation in the Contest.
11. TYPOGRAPHICAL AND OTHER ERRORS:
Illegible, incomplete, printed by machine or otherwise mechanically reproduced entries will not be accepted. Neither Sponsor nor the Related Parties are responsible for any lost, late, delayed, mutilated, illegible or misdirected entries, for any computer or technical malfunction, or for any typographical or other error in the printing of the offer, administration of the Contest or announcement of the prize winner. If winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, and/or if his/her prize notification is returned as undeliverable, winner will be disqualified and an alternate winner may be selected from the remaining eligible entries received.
12. GOVERNING LAW:
Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Sponsor, shall be construed and governed by the laws of the state of California, without regard to conflicts of law. All suits or claims brought in connection with this Contest must be brought in a state or federal court sitting in San Diego, California.
